Acceptance of Terms
These Terms of Service ("Terms") govern your use of the Klicky.ai platform, website, booking pages, and related services ("Services") operated by Klicky.ai ("we," "us," or "our").
By creating an account or using any part of our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
Service Description
Klicky.ai is an appointment booking and communication platform for local service businesses. The Services include:
- Online booking pages where your customers can schedule appointments
- A digital business card combining booking, services, gallery, and contact information in one shareable link
- WhatsApp notification delivery for booking confirmations, reminders, and follow-ups
- AI-powered message generation for notification templates
- A business dashboard for managing appointments, services, and settings
- A visual workflow builder for custom automations (Pro tier)
We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.
Accounts & Registration
To use the Services, you must:
- Be at least 18 years old or the age of majority in your jurisdiction
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account
You are responsible for all activity that occurs under your account. We may suspend or terminate accounts that violate these Terms or pose a risk to other users.
Subscription & Billing
Plans & Pricing
Klicky.ai offers Free, Basic, Growth, and Pro subscription tiers. Features and limits vary by tier and are described on our pricing page. We reserve the right to change pricing with 30 days' notice to existing subscribers.
Payment Processing
All payments are processed by Polar, which acts as our merchant of record. Polar handles billing, tax calculation, VAT compliance, and payment processing on our behalf. By subscribing, you also agree to Polar's terms of service.
Billing Cycle
Subscriptions are billed monthly or annually depending on your selection. Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date.
Refunds
We offer a 7-day refund policy from the date of purchase or renewal. To request a refund, contact us at [email protected]. After 7 days, refunds are provided at our discretion.
Acceptable Use
When using our Services, you agree not to:
- Send spam, bulk unsolicited messages, or promotional content through the WhatsApp notification system
- Use the platform to send messages that violate WhatsApp's terms of service or Meta's platform policies
- Upload illegal, harmful, or infringing content
- Attempt to reverse engineer, scrape, or extract data from the platform
- Impersonate another business or person
- Use the Services for any illegal activity
- Interfere with or disrupt the platform or its infrastructure
- Share your account credentials with unauthorized parties
WhatsApp messages sent through Klicky.ai must be transactional and appointment-related. You are responsible for obtaining appropriate consent from your customers before sending them WhatsApp notifications through the platform.
Customer Data & Consent
As a business using Klicky.ai, you are responsible for:
- Ensuring you have the right to use the phone numbers provided by your customers
- Informing your customers that they will receive WhatsApp appointment notifications
- Complying with applicable data protection laws (including GDPR, UK Data Protection Act, and local regulations) regarding your customers' personal data
- Responding to data subject requests from your customers in a timely manner
We process customer data on your behalf as a data processor. Our handling of this data is governed by our Privacy Policy and any applicable data processing agreement.
AI-Generated Content
Klicky.ai uses AI to generate notification message templates during onboarding. Regarding AI-generated content:
- AI-generated messages are suggestions and starting points, not final copy
- You are responsible for reviewing and editing all messages before they are sent to your customers
- We do not guarantee the accuracy, appropriateness, or legal compliance of AI-generated content
- No personal customer data is sent to AI providers; only your business type and tone preferences are used for generation
Intellectual Property
Our Property
The Klicky.ai platform, including its design, code, features, and branding, is owned by us and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Services during your subscription period.
Your Content
You retain ownership of all content you upload to the platform (business logos, gallery images, notification messages, etc.). By uploading content, you grant us a license to host, display, and transmit it as necessary to provide the Services.
Third-Party Services
Our Services rely on third-party providers for authentication, hosting, payments, email, messaging (including WhatsApp via Meta), AI, and related infrastructure. We are not responsible for:
- Service outages or disruptions caused by third-party providers
- Changes to third-party terms, pricing, or availability
- WhatsApp message delivery failures due to network issues, recipient phone status, or WhatsApp platform changes
We will make reasonable efforts to notify you of any third-party changes that materially affect the Services.
Limitation of Liability
To the maximum extent permitted by law:
- The Services are provided "as is" without warranties of any kind, whether express or implied
- We do not guarantee that the Services will be uninterrupted, error-free, or that WhatsApp messages will always be delivered
- Our total liability to you for any claims arising from or related to the Services shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost data
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
Termination
You may cancel your subscription and close your account at any time through the billing settings or by contacting us.
We may suspend or terminate your account if:
- You violate these Terms or our Acceptable Use policy
- Your use of the Services poses a risk to other users or the platform
- You fail to pay subscription fees after reasonable notice
- Required by law or a regulatory authority
Upon termination, your access to the Services will cease. We will retain your data for 30 days to allow recovery, after which it will be deleted in accordance with our Privacy Policy.
Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
Any disputes arising from these Terms or the Services shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes may be submitted to the courts of England and Wales.
If you are a consumer in the European Union, you retain any mandatory consumer protection rights under the laws of your country of residence.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you via email or an in-app notice at least 30 days before the changes take effect. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
